Please read these terms and conditions carefully before enrolling in any online training course ("Course") offered through our website: https://www.markbergsfishingexcellence.com.au (the "Website").

By proceeding with an enrolment, you agree to be bound by these terms, which form a legal agreement between you and Jurlark Pty Ltd (ABN 47 112 966 248), trading as Mark Berg's Fishing Excellence ("we," "us," or "our").

By clicking "I accept," you confirm that you are at least 18 years of age or have obtained permission from a legal guardian if enrolling a minor.

These terms may be updated periodically. Any changes will take effect immediately upon being posted on our Website.

These Terms apply specifically to course purchases.

By accepting these terms, you also agree to our Privacy Policy.

Course Enrolment

You will receive access only to the Course(s) you have paid for.

It is your responsibility to ensure all information provided during enrolment is accurate. Additional verification may be requested to process your enrolment.

Each Course constitutes a separate purchase.

You will be issued an account and login credentials upon registration. These are for your personal use only. You are responsible for all activities associated with your account, including purchases.

Any breach of these terms—whether by you or a minor registered by you—may result in immediate suspension or termination of access, without refund.

We reserve the right to terminate access if we believe your conduct may negatively impact our community or reputation.

Enrolment in a Course does not guarantee access to Mark Berg personally, either online or in person.

Pricing

All Course prices are listed in Australian Dollars (AUD) and are inclusive of GST.

Prices may be changed at our discretion without notice.

Payment

Payments can be made via credit card or other accepted methods specified on the Website.

Course payments are non-refundable unless required by Australian Consumer Law.

Order Processing & Changes

Course orders are processed immediately upon successful transaction.

Once an enrolment is paid for, changes to a different Course are not permitted.

Cancellation

Cancellation by You: Enrolments are final and cannot be cancelled or refunded unless required by law.

Cancellation by Us: If we cannot fulfil your order, we may cancel it and issue a full refund. No additional compensation will be offered.

Refund Policy

All Course fees are non-refundable unless otherwise mandated under Australian Consumer Law.

Privacy

We handle your personal data in accordance with our Privacy Policy, which forms part of these terms.

Intellectual Property

All content within our Courses is protected by Australian and international copyright laws and remains the property of Jurlark Pty Ltd or its licensors.

You may not:

• Copy, share, modify, frame, or distribute any content

• Reproduce materials for commercial purposes

We monitor access and usage to detect breaches and may suspend access if terms are violated.

Third-Party Materials and Websites

Our Courses may reference or link to third-party sites or communities, such as Facebook groups. These are not part of the Course and may be removed at any time without notice or liability.

We do not endorse or accept responsibility for third-party content.

Community and Group Participation

Access to Facebook or other community groups is limited to enrolled students and require an active subscription.

You must follow our Community Guidelines and refrain from posting:

• Harassing or offensive content

• Promotional or competing materials

• Infringing or impersonating content

We reserve the right to remove posts or suspend community access at our discretion.

By posting content, you:

• Grant us permission to use your content

• Warrant you have the right to share it

• Accept responsibility for it

Conduct and Participation

Mark Berg’s Fishing Excellence is a respectful, family-friendly environment. Sales pitches or solicitation within our community is not permitted.

Violation of conduct rules may result in removal from the Course and community with no refund.

Non-Disparagement

You agree not to make public or private comments that may harm the reputation of Mark Berg’s Fishing Excellence, our team, Courses, or community.

Disclaimer

Course content is for general information only and should not be considered as advice. We make no guarantee of results or outcomes. Fishing outcomes depend on many individual factors outside our control.

You participate at your own risk. Testimonials are genuine but not indicative of guaranteed results.

Liability

To the maximum extent permitted by law, we are not liable for any direct or indirect loss or damage resulting from Course participation, website use, or third-party tools.

Consent to Communication
